To comply with these regulations, exporters must determine whether their products or technology are subject to licensing requirements and obtain the necessary licenses before exporting controlled items.
To begin, exporters should familiarize themselves with the EAR’s definition of a “controlled” item. These are goods, software, and technologies that have military or dual-use applications, which can be used for both commercial and military purposes.
The EAR also imposes restrictions on the export of certain items to specific countries and regions, known as “prohibited” destinations. In addition, exporters must comply with various reporting requirements, including filing electronic Export Information (EEI) forms with U.S. Customs and Border Protection (CBP).
To ensure compliance, exporters should maintain accurate records of transactions, including shipping documents, invoices, and other relevant information. They must also notify the BIS if they experience any changes in their business or if they become aware of any violations.
