As soon as any symptoms persist or worsen after initial treatment. As crucial discussions unfold, the emergence of synthetic intelligence is poised to significantly reduce risk in scientific environments and empower physicians to focus on delivering top-tier care to patients at highest risk.
Researchers from the MIT Division of Electrical Engineering and Computer Science, along with Equality AI and Boston College, urge regulatory bodies to exercise greater oversight of AI development, as published in the October issue of a leading American publication, following a recent U.S. incident. The Office for Civil Rights (OCR), housed within the Department of Health and Human Services (HHS), has promulgated a new regulation under the Affordable Care Act.
In May, the OCR clarified within its ACA guidelines that prohibits discrimination based on race, color, national origin, age, disability, or sex in “individualized care decision support tools,” a newly defined term encompassing both AI and non-automated instruments used in medicine.
Enacted in response to a directive issued by President Joe Biden in 2023, the landmark regulation expands on the Biden-Harris administration’s commitment to promoting health equity by focusing on eradicating discriminatory practices and biases that perpetuate health disparities.
In line with senior creator Marzyeh Ghassemi, “the rule is a crucial step ahead.” A leading expert affiliated with MIT’s Abdul Latif Jameel Clinic for Machine Learning in Health, Computer Science and Artificial Intelligence Laboratory (CSAIL), and Institute for Medical Engineering and Science (IMES), Ghassemi emphasizes that the rule should inform equity-driven updates to non-AI algorithms and scientific decision-support tools already utilized across clinical subspecialties.

Researchers point out that no regulatory body oversees the scientific threat scores generated by clinical-decision support tools, despite most US hospitals using them; this lack of oversight raises concerns about the reliability and validity of these scores, potentially putting patient care at risk. Physicians utilize these instruments on a monthly basis to inform their decisions regarding patient care, with 65 percent of them relying on this data to guide subsequent treatment steps.
To address this limitation, the Jameel Clinic is planning to convene another seminal event in March 2025, which has already sparked a chain reaction of thought-provoking discussions and debates among educators, international regulators, and business strategists focused on the governance of artificial intelligence applications in healthcare.
“Medical threat scores are far more transparent than AI algorithms,” notes Isaac Kohane, chair of the Division of Biomedical Informatics at Harvard Medical School and editor-in-chief. “They typically involve just a few variables linked in a simple model.” Notwithstanding, even these scores are only as valid as the datasets employed to develop them and the variables that consultants have selected to investigate within a specific population. While older AIs may impact scientific decision-making, they must meet the same rigorous standards as their more advanced AI counterparts.
While some decision-support tools may eschew AI entirely, researchers note that even these instruments can be complicit in propagating biases within healthcare, necessitating vigilant monitoring.
According to Maia Hightower, CEO of Equality AI and a co-author, regulating scientific threat scores presents significant challenges due to the proliferation of scientific resolution assistance instruments embedded in digital medical information and their widespread adoption in research. “Regulations remain in place to ensure transparency and prevent discrimination.”
Despite this, the prospect of regulating scientific threat scores under the new administration appears daunting, considering its focus on deregulation and opposition to the Affordable Care Act and certain non-discrimination policies that might hinder such efforts.
