A Brazilian appeals court has overturned an injunction that blocked Apple’s App Store in the country.

Brazilian courts have overturned an injunction imposed on Apple, allowing the company to avoid permitting sideloading on iOS for Brazilian customers within 20 days, as reported earlier tonight.

Apple has been granted an extension by Brazil’s National Telecommunications Agency (ANATEL) to comply with a recent ruling requiring changes to its App Store operations.

A Brazilian federal court has ruled that the regulatory measures imposed on Apple are “disproportionate and unnecessary.” The judge found that the regulations had changed the company’s business operation in a subtle and structural way.

Brazil’s Cade regulatory agency gave Apple a deadline of November 26 to comply with antitrust regulations; failure to do so would result in fines of approximately $42,000 per day, up to a maximum of $250,000 daily. Apple had previously appealed the modifications, arguing they were excessively complex and would require an unreasonable amount of time to implement, making it impossible for the company to meet the 20-day deadline?

To remain competitive in Brazil’s market, Apple should consider implementing modifications that permit alternative app marketplaces alongside its App Store.
